Terms of Service

Welcome to Scalping-Algo. These Terms of Service ("Terms") govern your access to and use of the scalping-algo.com website, our TradingView indicators, signals, Discord/Whop community, educational content, and any related services (collectively, the "Services") provided by Scalping-Algo Ltd. ("we", "us", "our"). By accessing or using the Services you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to use the Services. By using the Services you represent that you meet these requirements.

2. Accounts and Access

Access to certain parts of the Services (indicators, community, signals) requires an active subscription purchased through our checkout or partner platforms (e.g. Whop). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend or terminate access for violations of these Terms.

3. License to Use

Subject to your compliance with these Terms and timely payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal trading and educational purposes only.

You may not:

• Resell, sublicense, lease, or redistribute the indicators, signals, or content.
• Reverse-engineer, decompile, or attempt to extract the source code of our indicators.
• Share account access, alerts, or community content with non-members.
• Use the Services to build a competing product.

4. Subscriptions, Billing, and Refunds

Subscription fees are billed in advance on a recurring basis (monthly, quarterly, or annually) until cancelled. You may cancel at any time from your account portal; cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy. Lifetime plans, where offered, are one-time payments for ongoing access subject to these Terms.

5. No Investment Advice

Scalping-Algo is not a registered investment advisor, broker, or dealer. All indicators, signals, alerts, content, and educational material are provided for informational and educational purposes only and do not constitute investment, financial, legal, or tax advice. You are solely responsible for your trading decisions. See our Risk Disclosure for important risk information.

6. Intellectual Property

All content, indicators, code, designs, logos, and materials made available through the Services are owned by or licensed to Scalping-Algo and protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

7. User Conduct

You agree not to: (a) violate any applicable law; (b) harass, abuse, or impersonate other members; (c) post unlawful, defamatory, or misleading content in our community channels; (d) attempt to disrupt or compromise the security of the Services.

8. Third-Party Services

The Services rely on third-party platforms (e.g. TradingView, Discord, Whop, Stripe). We are not responsible for the availability, content, or policies of these third parties. Your use of those platforms is governed by their own terms.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any signal will be profitable.

10. Limitation of Liability

To the maximum extent permitted by law, Scalping-Algo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, trading losses, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Scalping-Algo and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for breach of these Terms. Sections that by their nature should survive termination (e.g. IP, disclaimers, limitation of liability, indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of the Services after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Scalping-Algo Ltd. is incorporated, without regard to its conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
